Peer-to-Peer Car Rental Agreement

"Host" (Car Owner): An individual or entity that lists their vehicle for rent on the MotaShare platform.

"Guest" (Renter): An individual who rents a vehicle from a Host through the MotaShare platform.

"Platform" (MotaShare): The online marketplace and mobile application that connects Hosts and Guests for peer-to-peer car rental transactions.

To rent a vehicle through MotaShare, you must meet the following requirements:

• Be at least 21 years of age or older
• Hold a valid driver's license issued by a recognized authority
• Successfully pass MotaShare's verification process, which may include identity verification and driving record checks
• Provide accurate and complete information during registration
• Maintain valid insurance coverage as required by local regulations

MotaShare reserves the right to refuse service to any individual who does not meet these eligibility requirements or who has violated our terms in the past.

MotaShare functions solely as a connecting platform and is NOT liable for any incidents that occur during the rental period.

Guest Responsibility: The Guest (Renter) bears full responsibilityfor the vehicle while in their possession, including but not limited to:

• Accidents: Any accidents, collisions, or damage to the vehicle or third parties
• Theft: Loss or theft of the vehicle or its contents
• Damage: Any damage to the vehicle's interior, exterior, or mechanical components
• Traffic Fines: All traffic violations, parking tickets, toll fees, and related penalties
• Fuel: Maintaining appropriate fuel levels as agreed with the Host
• Insurance Claims: Filing and managing any insurance claims related to incidents

Platform Disclaimer: MotaShare does not own, operate, or control the vehicles listed on the platform. We are not responsible for the condition, safety, or legality of any vehicle. All rental agreements are made directly between the Host and Guest. MotaShare is not a party to these agreements and assumes no liability for disputes, damages, or losses arising from rental transactions.

Guests are strongly encouraged to obtain comprehensive insurance coverage and to thoroughly inspect vehicles before accepting them.

MotaShare's cancellation policy is designed to be fair to both Hosts and Guests:

No-Show Policy: If you fail to pick up the vehicle without canceling, you will be charged the full rental amount with no refund.

Host Cancellations: If a Host cancels a confirmed booking, the Guest will receive a full refund, and the Host may be subject to penalties as determined by MotaShare.

The following activities are strictly prohibited when renting a vehicle through MotaShare:

• Off-Roading: Using the vehicle for off-road driving, unless explicitly stated and approved by the Host in the vehicle listing
• Smoking: Smoking of any kind (tobacco, electronic cigarettes, etc.) inside the vehicle
• Illegal Activities: Using the vehicle for any illegal purposes, including but not limited to drug trafficking, smuggling, or any criminal activity
• Racing: Participating in races, speed contests, or any competitive driving events
• Unauthorized Drivers: Allowing anyone not listed on the rental agreement to operate the vehicle
• Subleasing: Renting, leasing, or lending the vehicle to third parties
• Overloading: Exceeding the vehicle's passenger or cargo capacity
• Towing: Towing or pushing other vehicles or trailers unless explicitly permitted
• Border Crossing: Taking the vehicle across international borders without prior written consent from the Host

Violation of these prohibited uses may result in immediate termination of the rental agreement, forfeiture of any refunds, additional charges for damages, and potential legal action.

Service Fees: MotaShare charges a service fee for facilitating the connection between Hosts and Guests. This fee is clearly displayed during the booking process and is non-refundable except in cases where the Host cancels the booking.

Late Return Penalties: Returning the vehicle later than the agreed-upon time may result in additional charges. Late fees are calculated as follows:

• Up to 1 hour late: 25% of the daily rental rate
• 1-3 hours late: 50% of the daily rental rate
• More than 3 hours late: Full daily rental rate for each additional day

Damage Fees: Any damage to the vehicle beyond normal wear and tear will be charged to the Guest. The cost will be determined based on repair estimates or replacement value.

Cleaning Fees: If the vehicle is returned in an excessively dirty condition, a cleaning fee may be charged. Standard cleaning fees range from $25 to $100 depending on the severity.

Fuel Charges: If the vehicle is not returned with the agreed-upon fuel level, you will be charged for the missing fuel plus a refueling service fee.

Traffic Violations: Any traffic fines, parking tickets, or toll charges incurred during the rental period are the Guest's responsibility. MotaShare may charge an administrative fee for processing these violations.

Modifications: MotaShare reserves the right to modify these terms and conditions at any time. Users will be notified of significant changes via email or platform notification.

Governing Law: These terms are governed by the laws of Zimbabwe. Any disputes arising from the use of the platform shall be resolved in accordance with Zimbabwean law.

Dispute Resolution: In the event of a dispute between a Host and Guest, MotaShare may provide mediation services but is not obligated to do so. Final resolution is the responsibility of the parties involved.

Account Termination: MotaShare reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users or the platform.

Privacy: Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference.
